This End-User License Agreement (“EULA”) is concluded between you (“End-User”) and Sub37 Labs only, and not with Apple Inc. (“Apple”). Sub37 Labs, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not conflict with the Apple Media Services Terms and Conditions.
Sub37 Labs grants you a non-transferable, non-exclusive license to use the Licensed Application on any Apple-branded products that you own or control, in accordance with the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may also be accessed by other accounts associated with the purchaser via Family Sharing or volume purchasing.

Certain features require a paid subscription. ZumFlo offers two tiers:
Both tiers are available as monthly or yearly subscriptions. Payments are handled via your Apple ID account. Sub37 Labs has no access to your payment details.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period via your Apple ID settings. No refund is provided for the unused portion of a current subscription period.
If you are a consumer residing in the European Union or the European Economic Area, you have the right to withdraw from a subscription purchase within 14 days of the transaction date, without giving any reason.
However, by downloading and using the Licensed Application or by starting a subscription, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the digital content has been fully provided or the subscription period has commenced.
All subscription purchases and refund requests are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. Sub37 Labs cannot process refunds directly.
Please note: ZumFlo is developed solely as a supportive administrative tool.
Sub37 Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application.
To the extent permitted by law, the Licensed Application is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Sub37 Labs is solely responsible for providing any maintenance and support services with respect to the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Licensed Application.
You and Sub37 Labs acknowledge that Sub37 Labs, not Apple, is responsible for addressing any claims of the End-User or any third party relating to the Licensed Application or the End-User’s possession and/or use of that Licensed Application, including but not limited to:
The App may contain integrations with third-party services, including but not limited to SumUp, PayPal POS, and Moneybird. Sub37 Labs only facilitates the technical connection and is not responsible for the operation, availability, accuracy, or content of these external services. Use of these services is subject to their respective terms and privacy policies.

You agree to comply with all applicable third-party terms of agreement when using the Licensed Application, including the terms of your mobile data provider, payment processor, and bookkeeping platform, as applicable.
All intellectual property rights in the Licensed Application are owned by Sub37 Labs or its licensors. In the event of any third-party intellectual property infringement claim, Sub37 Labs, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
The Licensed Application uses certain open-source software components under their respective licenses. Details and attributions are available within the App under My Business → Settings → Open source licenses.
All text, images, designs and other content on zumflo.app are protected by copyright and owned by Sub37 Labs. No part of this website may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, photocopying, recording or otherwise, without the prior written permission of Sub37 Labs.
To the maximum extent permitted by applicable law:
These limitations do not apply to the extent that mandatory law provides otherwise.
You represent and warrant that:
You may not use or otherwise export or re-export the Licensed Application except as authorised by applicable export laws and regulations.
This EULA is effective until terminated by you or Sub37 Labs. Your rights terminate automatically if you fail to comply with any of its terms. Sub37 Labs reserves the right to modify, suspend, or discontinue the App at any time.
Upon termination or downgrade of your subscription, your data remains on your device. Access to certain features may be restricted, but no data is deleted. You can export your data at any time before or after termination.
Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA and have the right to enforce this EULA against you.
This EULA is governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in the Netherlands, without prejudice to mandatory consumer protection provisions of your country of residence.
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
